Indian expats travel home for weddings, emergencies, festivals and family visits. A pending criminal complaint or investigation in the UAE can change that overnight. Here is how travel restrictions work in criminal cases, how to check your status, and what to weigh before you plan a trip to India.
Can an Indian citizen leave the UAE while facing criminal charges?
Often not without the authorities' agreement. Under the Criminal Procedures Law (Federal Decree-Law No. 38 of 2022), the Public Prosecution can issue a travel ban during an investigation. A travel ban can also be a condition of provisional release, alongside a personal guarantee or a bail bond (Article 109). If a ban is in place, you will be stopped at immigration.
If no ban has been issued, you may be able to leave physically, but the case does not stop. Leaving without resolving it can lead to serious consequences, explained below.
Understanding travel restrictions in criminal investigations
- Travel bans are issued by the Public Prosecution or the court, not by the complainant. A complainant can ask for one, but the authority decides.
- Criminal travel bans usually stay in place until the investigation or court case ends, or until the authority lifts them.
- Your passport may be held as a condition of release.
- A travel ban linked to a criminal case is separate from bans linked to civil debts, rent disputes or immigration violations, which follow their own procedures.
How to check whether a travel ban exists
There is no single national search, so check through the relevant emirate:
- Dubai: the Dubai Police app or website, under the "Criminal Status of Financial Cases" service, using your Emirates ID and a one-time password. In 2026 Dubai Police also launched a UAE Pass service to check and settle some travel bans online. Its first phase covers rental-dispute bans, with the courts and the Public Prosecution to follow, so criminal bans may not appear there yet.
- Abu Dhabi: the Abu Dhabi Judicial Department's Estafser service, using your UID number.
- Other emirates: the relevant police, court or public prosecution channels, or a visit to a police station.
- Through a lawyer: if you are outside the UAE or cannot use these services, a UAE lawyer acting under a power of attorney can check for you.
Check well before booking flights. A ban discovered at the airport means a missed flight and, sometimes, questioning.
Can a criminal complaint affect UAE residency and employment?
A complaint or investigation does not by itself cancel your residence visa. In practice, though, it can create real difficulties:
- a travel ban or detention can make it hard to renew documents on time or travel for work;
- your employer may not be able to keep you working if you are detained or cannot travel as your role requires;
- under the UAE Labour Law, a final conviction for certain offences, such as those involving honour or honesty, can allow an employer to end employment without notice;
- a conviction can lead to deportation: mandatory for a felony with a custodial sentence, and at the court's discretion for misdemeanours (Penal Code, Article 126).
Tell your lawyer about your visa and employment position early, so these risks are part of the strategy.
What legal options may be available to challenge or lift travel restrictions?
- Request release on guarantee: ask the Public Prosecution to replace a travel ban with a financial or personal guarantee where appropriate.
- Apply for a temporary lift: for urgent reasons, such as a family emergency, a request supported by documents and sometimes a guarantee may be considered.
- Raise a grievance or appeal: the Ministry of Justice offers an online service to appeal a travel ban issued in a criminal case, with supporting documents.
- Resolve the underlying case: dismissal, acquittal, reconciliation or penal mediation for eligible offences (Articles 348–356), or a waiver by the complainant for complaint-based offences such as insult (Article 17), can end the case and with it the travel restriction.
Outcomes depend on the offence, the stage of the case and the authority involved. A lawyer licensed in the relevant emirate can tell you which route is realistic.
What happens if you return to India while a UAE criminal case is unresolved?
Leaving does not close the file. Possible consequences include:
- a judgment in your absence: for felonies, and misdemeanours carrying more than a fine, the accused must normally attend in person (Article 161);
- for misdemeanours, an absentee judgment can be challenged by filing an opposition within 7 days of notice (Article 229), and if an absent accused appears before judgment is pronounced the case is reheard (Article 171);
- an arrest warrant or circular that leads to arrest when you next enter the UAE, including on transit;
- in serious cases, international measures: India and the UAE have an extradition treaty and cooperate in criminal matters.
If you are already in India, do not ignore the case. A UAE lawyer acting under a power of attorney can check its status, represent you where the law allows, and advise on whether the matter can be settled, dismissed or defended.
Frequently asked questions
Can I fly to India if a police complaint has been filed against me in the UAE?
Only if no travel ban has been issued, and even then the case continues in your absence. Check your status first and take legal advice before travelling.
How do I check for a travel ban in Dubai?
Use the Dubai Police app or website (Criminal Status of Financial Cases service) with your Emirates ID, or ask a UAE lawyer to check for you under a power of attorney.
Can a travel ban in a criminal case be lifted?
Yes, in some cases: through release on a guarantee, a temporary lift for urgent reasons, a Ministry of Justice appeal, or by resolving the case through dismissal, acquittal, reconciliation or a complainant's waiver where the law allows.
What happens if I leave the UAE and do not return for my case?
The case can proceed and a judgment can be issued in your absence. An arrest warrant may be waiting when you next enter the UAE, and serious cases can involve international cooperation, including under the India–UAE extradition treaty.
